Curaçao defines itself as the Bridge between the Americas and the European Union. Curaçao is a protectorat from the Netherlands, similar to the situation of Puerto Rico with the USA). People born in Curaçao hold a European Union passport, issued by the Netherlands.

Curaçao supports the development of the Transnational Education (TNE) in the Caribbean. It is the base of several TNE institutions and facilities offering a wide range of programs to students from Europe, the United States, Latin America and the Caribbean. The government of Curaçao has adopted the UNESCO guidelines for quality provision in cross-border higher education. It has created a website that provides students with an overview of institutions established in Curaçao and the programs and diplomas they offer and the accreditation they hold.

The Government of Curaçao has approved a Transnational Education policy in 2015, creating a formal structure for a development and approval of higher education institutions. The Government of Curaçao does not provide accreditation, but a charter is provided, recognizing the institution on Curaçao.

Education in Curaçao is governed by the principle of freedom of education. Any charter granted to a higher education institution or university should be accredited by an accrediting body which is approved by the Government of Curaçao, or provide sufficient equivalent academic quality guarantees. The Ministry of Education will require the endorsement of the Ministry of Economy and the Ministry of Labor to ensure that the approved institution's degrees are fit for labor purposes. Further advise from other government officials and departments may be required before a charter is granted, including the signature of the Governor, acting in representation of the endorsement by the Netherlands.

On February 22, 2018, Drs. Marilyn Alcalá-Wallé, acting Minister of Education, granted the official charter to Bircham International University. This charter becomes one of the steps towards the global and indisputable recognition of the innovative and efficient distance learning higher education adapted to the needs of the working professional that defines Bircham International University.

Other Ministries of Education has also confirmed written recognition of Bircham International University. This recognition though also depends on the professional profile of the BIU graduate. The examples exposed are from Saint Lucia, also in the Caribbean; and the Higher Education Council from Rwanda.
